What is a prenuptial agreement?

Without a prenuptial agreement, spouses generally have marital rights to each other’s property. This means that all property is, as a rule, added together and divided equally in the division of matrimonial property, regardless of whose name the property is in.

With a prenuptial agreement, spouses can agree, for example, that each spouse keeps their own property separate, so that no marital right arises at all, or that the marital right only applies to certain property, such as a jointly acquired home, but not to inheritances or gifts.

A prenuptial agreement is a preventive and protective document that allows spouses to plan their financial relationship openly and fairly. It can be especially important in blended families, for entrepreneurs, or where there is an imbalance in the spouses’ wealth, or where one spouse has received gifts or inheritances.

For a prenuptial agreement to be valid, it must be made in writing and registered with the Digital and Population Data Services Agency before the marriage ends.

No. A spouse never inherits their deceased spouse if they have children. In this situation, the spouse’s inheritance rights can only be secured by a will.

However, if one spouse dies, the surviving spouse may receive an equalization payment based on marital rights. This requires that:

  1. The surviving spouse owns less property than the deceased spouse; and
  2. The spouses do not have a prenuptial agreement, or the prenuptial agreement states that it does not apply if the marriage ends due to the death of one spouse.

When you get married, you and your spouse receive marital rights to each other’s property. Marital rights are realized when the marriage ends, either due to divorce or death, at which point the spouses’ marital rights and assets are calculated in the division of matrimonial property.

If there is no prenuptial agreement, both joint and individually owned property are taken into account in the division of matrimonial property. If either spouse owns business assets or has received gifts or inheritances, these are also taken into account in the division.
